PostPosted: Tue Aug 07, 2007 7:52 pm    Post subject: WA cops..... thanks boys Reply with quote

Just had a lovely run in with the local cops in perth...
Firstly can anyone tell me what undue and excessive noise is??? in a stock standard EB 5.0 Fairy, no exhaust mods yet.
Heres the story anyway... Leaving the post office car park in gossy this morning was already rolling, seen the lights on the corner go green, gave it about half throttle to beat the traffic, no wheel spin. Got about half way accross the road and seen this cop on foot waiving and yelling for me to pull over. so i stopped on the road, he started yelling and told me to pull over in the car park around the corner making well known that he had my plates.
Now my car is in pretty good nick with nothing really to defect me for so he started explaining the hoon laws to me, i tried to explain that the car is standard bar body work but he didn't want to hear it. So i ended up back at the cop shop with him after he walked off with my licence. An hour later i finally get out with nothing but a $100 fine...
So how can a normal cop decide what it and what isn't excessive noise???
So thanks again orificer....

my brother got the exact same "undue and excessive noise" fine on his completely stock nanna spec ef futura.

he got it when he took off from a set of lights (not being d***head or anything) faster then average.

nothing ya can do about it really... some people like just feeling important.

Take em to court and ask exactly how the cop was able to determine the noise was excessive, did he have some metering device.

Otherwise if it was only him its your word against his.

Talk to a solicitor if you believe you are in the right.

And take the time off work, pay court fees/ solicetor fees... for only a $100 fine. I think they have me by the short and curlys, it will cost me more in lost wages than it is worth to maybe win. if they were taking points as well i would consider fighting it.

Fess up, its $100

I know its not right, and I am totally with ya, BUT he's a cop, your not.

He'll win, and you'll pay.

Odd chance you win, he's got your details he'll get you again.

A solicitor will only f**k you even harder.

I like to think of it like the Doc's, they send people off the the chiropractor, then the naturopathic etc etc, till they bleed you dry!

i think, from the coppers perspective, he thought that your application of the throttle was too excessive and subsequently, too noisy. Same with people getting tickets for "excessive acceleration" and such. All would be similar things, and down to the individual coppas discretion. THey could probably even pull up grandad in the camry if they wanted to! Still, a bit over the top in my opinion.

next theyre probably gonna fine people for excessive braking when there hitting the picks because some f**k in a fully sik VN pulls out infront of you. you get the fine, and Habib in his VN takes off like a bat out of hell, and the cop dosent even notice. icon_mad.gif

too noisy on albany hwy??? either the cop is deaf and only heard my car or he was just being a prick. i only had enough pedal on to get accross traffic and in my car thats not loud.... which again brings the question how can one cop decide whats to excessive in throttle or noise.

never been to perth, so don't know the albany hwy. I would probably say he was just being a prick, or had a bad day to be in the prick mood, and needed to get the quota up.

Yer I've had roughly 6 'random' licence checks in the past 6 weeks. Thats twice as many as Ive had in the past 3 years. Good to see lots of cops around, but seriously they should be where they are needed, not cruising around the suburbs.

Btw, are cops allowed to open your bonnet and look through your car after waving you off the road (he was on the sidewalk, no camera).
